Terms, Privacy and Cookies
One document, because three was two too many. Effective on the date below.

This is the whole agreement between you and FrankVenture LLC, which owns and operates GoNoGo WX at gonogowx.com(the “Service”). It replaces the separate Terms of Service, Privacy Policy and Cookie Policy, which said the same things in three places. Using the Service means you agree to it. You need to be at least 18.
Safety notice
GoNoGo WX is a decision-support tool for reference and situational awareness only. It is not a guarantee of safety and it is not a navigation system. It reads public weather data against limits you set and suggests GO, CAUTION or NO-GO. Weather data can be wrong, late, incomplete or missing, and conditions change fast.
Do not use it as a primary means of navigation or as the basis for any course, heading, altitude, routing or maneuvering decision. Navigate with your certified instruments, official charts and your own eyes. It is not intended for any use where its failure or inaccuracy could lead to death, injury, or damage to property or the environment.
The go/no-go decision is always yours. A GO is never permission to proceed and a NO-GO is never an instruction. This is not a substitute for official forecasts and marine warnings, an FAA briefing, NOTAMs, METARs and TAFs, Notices to Mariners, ATC, or your own training and judgment. Consult them.
On the water, comply with the Navigation Rules / COLREGS. In the air, comply with the Federal Aviation Regulations. In an emergency call 911, the U.S. Coast Guard, or Air Traffic Control.
What we collect, and what we do with it
Four things, and that is the whole list:
- Your account: a name or display name, your email address, and a hashed password. We never store your password in readable form.
- Your boat and your limits: the vessel profile and the threshold numbers you set. This is what makes a briefing yours rather than a forecast.
- Places, which is location data: your home port, saved spots and planned destinations, and any coordinates or place names you type in to get a read. We use them to fetch conditions for those places.
- Usage and device data: basic server logs, and, only if you consent, product analytics.
- Whether you opened the daily briefing: the email carries a small invisible image and its link is counted, so we can see whether the briefing is being read at all. We keep the first open and the first click per day and nothing else: no record of how long you looked, how many times you came back, what device you were on, or where you were.
We use all of it to run the Service: to produce your reads, keep your profile across sessions, operate your account, take payment, send you the email you asked for, keep the Service secure, and to understand how the product is used and how well our marketing works, so we can make it better. That last one includes analytics and marketing metrics, and we would rather say so plainly than bury it.
What we never do
We never sell your information. Not to anyone, not in any form, not under any other name for it. We do not share it with advertisers or data brokers, we run no cross-site advertising trackers, no retargeting pixels and no ad cookies, and we do not use your saved places to build a profile of you for anybody else.
Who else touches it
Only the providers who make the Service run, under contract, and only as far as they need to: our hosting provider (Cloudflare), our weather sources (the National Weather Service / NOAA, aviationweather.gov, Open-Meteo), our email provider (Resend), our analytics provider (PostHog, and only if you consent), and our payment processor, which handles card data so that we never hold a full card number. We disclose information otherwise only where the law requires it or to protect someone’s safety.
What we put on your device
- A session cookie (
gng_session), signed andhttpOnly, which keeps you signed in. It is strictly necessary and cannot be switched off while you are using an account. - Local storage for your preferences and your cookie choice. It stays on your device and is not used to follow you anywhere.
- Analytics, only if you accept. PostHog, hosted in the United States, which sets a cookie like
ph_[project]_posthogto recognize your device between visits. We do not load it unless you say yes, we keep session recording and autocapture switched off, and we honor your browser’s Do Not Track signal.
Change your mind whenever you like, from the cookie banner or your browser settings. Blocking the session cookie will sign you out.
Your data, your call
- Download everything we hold on youas a file, from the “Your data” card in Settings: your account, your boat and limits, your saved spots and your logbook.
- Delete your account from the same card, yourself, in one place. It erases your profile, your boat and limits, your saved spots and your logbook, stops the briefing and releases your email address. If you have a subscription it is canceled first, and if that cancellation fails we delete nothing and tell you so.
- See or correct your account information in settings, or ask us and we will do it.
- Unsubscribe from product and marketing email with the link in any of them. Every send carries one.
- Manage analytics consent from the cookie banner at any time.
- Depending on where you live (California, Virginia, Colorado, Connecticut, Utah, the EU and UK among others) you may have further rights to access, delete or port your data and to opt out of certain processing. Ask us and we will honor them.
We keep your information while your account is active and as long as the law requires, then delete or anonymize it. Two things outlive a deletion for a short while and it is fairer to say so than to imply otherwise: a briefing or share link you generated is cached against an opaque id with no route back to your account, and the record of whether a briefing was opened is kept by day. Neither carries your name, we cannot look either of them up by account, and both expire on their own: cached reads within 30 days, open counts within 90. We protect what we hold with reasonable technical and organizational measures, though no method is perfect. The Service is not for children under 18 and we do not knowingly collect their information; tell us if you think we have and we will delete it.
Using the Service
GoNoGo WX produces marine, aviation and outdoors go/no-go reads against thresholds you set. We may add, change or drop features. Verticals are sold separately; access to one is not access to another unless you hold a bundle or a comped plan. You are responsible for your password and for what happens under your account, and for giving us accurate information.
Reference use only. Everything the Service produces (reads, outlooks, decoded reports including METARs, TAFs, PIREPs and SIGMETs, diagrams and text) is for reference and situational awareness. None of it is certified for navigation or a substitute for your own judgment, and it must be used alongside official charts, publications, briefings and instruments.
If you are flying, you are the pilot in command and solely responsible for the safe operation of the aircraft and for compliance with the Federal Aviation Regulations, including everything 14 CFR 91.103 requires before a flight. The Service is not an official weather briefing, is not FAA-approved for navigation, and satisfies no preflight, weather or NOTAM requirement on its own. Verify the active runway, conditions, NOTAMs and every critical item through official sources before and during flight.
If you are on the water, you are the operator and solely responsible for the safe conduct of the voyage, for the Navigation Rules / COLREGS and every applicable law, and for monitoring VHF weather, marine warnings, local advisories and your own observations.
You use the Service at your sole risk and you assume that risk, along with the risk of any decision you make, or fail to make, in connection with it.
You agree not to:
- use the Service unlawfully or against these terms;
- use it as a primary means of navigation, or for any safety-critical purpose it is not built for;
- scrape, resell or redistribute it or its data without permission;
- interfere with it, overload it, or try to reach parts of it you are not entitled to; or
- make it the sole basis of a safety-critical decision.
Where the data comes from
The Service depends on third-party data and providers, and we do not control the accuracy, availability, completeness, timeliness or formatting of anything they publish. We do not promise that the original sources, the FAA and the National Weather Service included, have given us data that is accurate, complete, timely or properly formatted.
Some of what we say is drawn from published navigational references such as the US Coast Pilot, and where it is, we cite the volume and paragraph so you can look it up. We work from the most current edition available to us, but editions and weekly corrections come out on the publisher’s schedule rather than ours, and we do not promise that a citation reflects the latest edition or that the reference is still correct. Shoals, bars and channels move between surveys. Nothing cited here replaces current charts, Local Notices to Mariners, or your own judgment.
Every dataset behind a read, who it belongs to and the license it is used under, is listed at Data sources. None of those sources endorse GoNoGo WX or checked our arithmetic.
Subscriptions
Paid plans renew automatically. When you subscribe, your plan automatically renews at the end of each term: every month on a monthly plan, every year on an annual plan. At each renewal we charge the card on file the then-current price for your plan. The price you will be charged, and the date of your next renewal, are shown to you before you subscribe, again in the acknowledgment email we send when you do, and at any time in Settings. On an annual plan we also email you in advance of each renewal.
It continues until you cancel. There is no separate step to keep your subscription; it runs until you stop it. You can cancel at any time, online and in one place, from Settings. Canceling takes effect at the end of the period you have already paid for: it stops all future charges, and your access runs to the end of that period. To avoid being charged for the next term, cancel before the renewal date shown in Settings.
Refunds. Fees for a period already begun are generally non-refundable, but this does not limit rights you have under the law of your state, and it is not the whole of our practice: if a renewal charge takes you by surprise, write to us at support@gonogowx.com within 14 days of the charge and we will refund it. We may change prices going forward, with notice to you before the change takes effect.
If we discontinue the Service. We may stop offering GoNoGo WX. If we do, we will tell you by email at least 30 days before the shutdown date, your access continues until that date, and we will refund the unused portion of anything you have already paid, pro rata to the day we stop. You do not need to ask: the refund goes back to the card the charge came from, and if that card no longer works we will write to you to arrange it. We will also cancel all future billing at the same time, so there is no renewal to catch. Before the shutdown date you can export your data from Settings.
What you own stays yours: the thresholds and data you enter are your property, and the Service itself, its software, design and content, is ours, licensed to you for personal, non-commercial use and revocable if you break these terms.
Disclaimer of warranties
THE SERVICE, AND ALL DATA, READS, OUTLOOKS AND CONTENT AVAILABLE THROUGH IT, ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS OR RELIABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY READ OR DATUM IS ACCURATE, COMPLETE, TIMELY OR CURRENT, OR THAT THE ORIGINAL DATA SOURCES (INCLUDING THE FAA AND THE NATIONAL WEATHER SERVICE) HAVE PROVIDED DATA THAT IS ACCURATE, COMPLETE, TIMELY OR PROPERLY FORMATTED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THIS MAY NOT APPLY TO YOU.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FRANKVENTURE LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, PROPERTY (INCLUDING ANY AIRCRAFT OR VESSEL), PERSONAL INJURY OR DEATH, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY DECISION YOU MAKE BASED ON IT, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED DOLLARS ($100.00). You acknowledge that this allocation of risk is a basis of the bargain and reflects the fees charged.
Indemnification
You agree to defend, indemnify and hold harmless FrankVenture LLCand its members, managers, officers, employees, agents, licensors and service providers against any claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys’ fees), including for injury to or death of any person or loss of or damage to any property (including any aircraft or vessel), arising out of or relating to: (a) your use of the Service; (b) your breach of these terms or of any law; (c) your violation of anyone else’s rights; or (d) any decision you make, or fail to make, based on the Service, including any go/no-go decision. This survives the end of your account.
Ending it, and the fine print
Stop using the Service whenever you like. We may suspend or end your access if you break these terms or to protect the Service. The parts that should outlive the account do: reference-use-only, the warranty disclaimer, the limitation of liability, the indemnity, and governing law. These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and you agree to the exclusive jurisdiction and venue of the state and federal courts in Dallas County, Texas for any dispute not otherwise agreed. If any provision is unenforceable the rest stand. This document is the entire agreement between us about the Service. We may update it; material changes take effect when posted with a new effective date, and continued use is acceptance.

What changed on August 17, 2026
The Subscriptions section now states the auto-renewal terms in full.It previously said paid plans “bill in advance on a recurring basis” and that you could cancel any time, which was true but incomplete: it never used the words automatically renew, never gave the renewal price or how often it recurs, never said that the subscription continues until you stop it, and never said where the cancel control is. All of that is now written down, and the same facts appear before you subscribe, in an acknowledgment email when you do, and in Settings. On annual plans we also email you before each renewal.
The refund sentence changed.It read “fees are non-refundable except where the law says otherwise”, which contradicted our own FAQ telling captains to email us. If a renewal charge surprises you, write within 14 days and we will refund it. Nothing else in this document changed. Version 2026-08-17; the previous version was 2026-08-16.
Before 2026-08-16 there were three documents: Terms of Service, a Privacy Policy and a Cookie Policy. They are now one, at this address, and the old links redirect here. Nothing was given up in that merge: the safety notice, the disclaimers, the limitation of liability and the full list of what we collect and who receives it are all still here, in fewer words, and we never sell your information.
